Time limits and amounts for Home Warranty

Home Warranty has rules about:

  • how long cover lasts
  • when a claim must be made
  • how much assistance may be available.

The timeframes and amounts depend on the type of issue, the building work and the circumstances of the claim.

Home Warranty is subject to eligibility requirements, limits, exclusions and claim assessment.

How long cover lasts

Home Warranty cover depends on the type of issue.

Issue Cover period
Major defects Up to 6 years after the eligible domestic building work is completed
Other defects or non-compliant work Up to 2 years after the eligible domestic building work is completed

Major defects may include:

  • structural defects
  • waterproofing defects
  • weatherproofing defects.

Other defects are defects or non-compliant work that are not major defects and are not minor cosmetic differences.

Home Warranty does not cover minor cosmetic differences between the completed work and the plans and specifications in your building contract. You can read BPC’s minor cosmetic difference determination for examples of circumstances where assistance will not be available.

When to make a claim

Act as soon as you become aware of a problem.

Different claim timeframes apply depending on the type of claim.

Incomplete work, including costs to secure the building site Within 12 months after the relevant insurable domestic building contract event happens
Defective or non-compliant work Within 12 months after you first become aware, or should reasonably have become aware, of the issue
Accommodation, removal and storage costs Within 28 days after the costs are incurred  

Do not wait until the cover period is about to end. A claim must be made within the required claim period.

Incomplete work

For incomplete work, an insurable domestic building contract event may include where the builder:

  • has died or disappeared
  • cannot be found
  • is a company in external administration or has been deregistered
  • is insolvent
  • is unable to pay debts when they are due
  • has had their registration cancelled by BPC
  • has defaulted under the contract and the contract has been validly terminated.

How much assistance may be available

The maximum amount of assistance available under Home Warranty is $400,000 in total per home.

Other limits may also apply.

The amount of assistance available may depend on:

  • what you have already paid the builder
  • what work remains incomplete
  • whether progress payments were made before progress stages were complete
  • the cost to complete or rectify the work
  • whether the issue is a minor cosmetic difference
  • whether other limits or exclusions apply.

If you think there is a problem

If you think there is a problem with your building work, act early and keep records.

Keep copies of your:

  • building contract
  • plans and specifications
  • building permits
  • payment records
  • Notice of Cover
  • emails, letters and messages with your builder
  • photos or reports showing the issue.

Limits on the period of cover and timeframes for making a claim apply. Do not wait to seek advice.
